The present petition has been filed by the petitioner seeking a direction to the respondent no. 2 to decide Misc. Appeal No. D20255470000025 (Niyaz Ahmad Vs. Prescribed Authority and others) arising out of under Section 15(2) of the Uttar Pradesh (Regulations of Building Operations) Act, 1958. The appeal is said to be pending since January, 2025. Learned Standing Counsel states that an appropriate decision would be taken expeditiously. In view of the aforesaid facts, this writ petition stands disposed of with a direction upon the respondent no. 2 to decide Misc. Appeal No. D20255470000025 (Niyaz Ahmad Vs. Prescribed Authority and others) arising out of under Section 15(2) of the Uttar Pradesh (Regulations of Building Operations) Act, 1958, in accordance with law, within a period of three months, from the date of presentation of a certified copy of this order, if there is no other legal impediment. It is, however, clarified that this Court has not examined the claim of the petitioner on merits and all issues are left open to be considered by the authority competent, at the first instance.
