Applicant-Shehmeena Khatoon has filed this petition under Section 407 Code of Criminal Procedure for transfer of Sessions Trial No. 405 of 2022; titled State of U.P. vs. Ikramul Haq, arising out of Case Crime No. 41 of 2022, under Sections 498A, 304B IPC and Section 3/4 Dowry Prohibition Act, registered at Police Station Suriyawan, District Bhadohi pending before Additional District And Sessions Judge/Fast Track Court-I, District Bhadohi to any other court of competent jurisdiction at District Prayagraj. Applicant-informant is seeking transfer of the trial from Bhadohi to Prayagraj on the ground that she is not keeping good health, and on her appearance, the accused may harass her. Since, the prosecution case is based upon police report, wherein applicant only at best is a witness, therefore, this Court is not inclined to transfer the case, particularly when the distance between the two towns is only 60 kms. Resultantly, the application fails and is hereby dismissed.
