The appellant proposes to challenge the judgment and order dated 23.07.2025, passed in Criminal Appeal No.40 of 2024, Laxmi Bharti Vs. Rajendra Singh @ Rajesh Singh and another, by the court of Additional Sessions Judge, Kotdwar, District Pauri Garhwal, by which the respondent no.2 has been acquitted of the charge under Section 138 of the Negotiable Instruments, 1881. He seeks leave to appeal. Learned counsel for the petitioner submits that, in fact, trial court had convicted the respondent no.2, but the appellate court has acquitted her. Having considered, this Court is of the view that this is a fit case in which the leave to appeal may be granted. The leave to appeal is granted. Admit. Let call for the LCR.
