Heard Sri Vinay Pandey, learned counsel for the petitioner and learned Standing Counsel for the respondent nos.1 and 2. The present writ petition has been filed for a direction upon respondents authorities to decide the Execution Case No.106 of 2023 under Section 6- H(1) Meghlal Tarafdas Vs. Manager/Employer M/s Silver Appreals Pvt. Ltd. and others, which is pending before the court of respondent no.2/Deputy Labour Commissioner, Noida, District Gautam Budh Nagar. It is contended by learned counsel for the petitioner that in Adjudication Case No.301 of 2011 (Meghi Lal Vs. Manager, M/s Silver Appreals Pvt. Ltd.), an award was passed by the Labour Court on 19.11.2018. Petitioner has filed an application under Section 6-H(1) before respondent no.2, which is still pending. In view of the aforesaid facts, the present writ petition stands disposed of with a direction upon respondent no.2 to decide the Execution Case No.106 of 2023 under Section 6-H(1) pending before him, in accordance with law, expeditiously, preferably within a period of three months from the date of presentation of a certified copy of this order, if there is no other legal impediment.
