Petitioner apprehends arrest in a case registered for the offences punishable under Sections 2, 33, 41, 42 of the Indian Forest Act and Sections 27, 29, 31, 32 of the Wildlife (Protection) Act. 3. As per prosecution case, 20 pieces of logs of Shisham wood was recovered from the sahan situated in front of the house of petitioner. 4. Learned counsel for the petitioner submits that no incriminating material has been recovered from conscious possession of the petitioner and he is no way connected with the aforesaid recovery. Recovery has been made from an open place and petitioner has been made accused only on suspicion. Patna High Court CR. MISC. Considering the nature of accusation, place of recovery and clean antecedent, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail- bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bettiah, West Champaran in connection with Forest Case No. 47F of 2014, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
