After arguing for a while, learned counsel for the petitioners submits that the petitioners be permitted to withdraw the instant petition with liberty to avail appropriate remedy as available under law, so as to protect the suit property and further the petitioners be permitted to lay appropriate motion before the learned trial court for waiving off the costs imposed upon the petitioners. 5. In view of the above, the instant petition is disposed of along with the connected application, with liberty to the petitioners as prayed for Serial No. 70 2 CM(M) No. 354/2025 and in the event any such application is filed by the petitioners before the learned trial court for waiving off the costs, this Court requests the learned trial court i.e. the court of learned Principal District and Sessions Judge, Samba to consider the same sympathetically in accordance with law.
