( 2025:JHHC:12338 ) IN THE HIGH COURT OF JHARKHAND AT RANCHI A.B.A. No. 2377 of 2025 ------ Ramesh Kumar Singh @ Ramesh Singh, aged about 48 years, son of Ram Ayodhaya Singh, resident of Village-Joshi Colony, P.O. & P.S.-B.S. City, Dist.-Bokaro … Petitioner Versus The State of Jharkhand … Opposite Party ------ CORAM: HON’BLE MR. JUSTICE ANIL KUMAR CHOUDHARY ------ For the Petitioner : Mr. Rakesh Kumar, Advocate For the State : Mr. Saket Kumar, Addl. P.P. ------ Order No.02 Dated- 25.04.2025 Heard the parties. Apprehending his arrest, the petitioner has moved this Court for grant of privilege of anticipatory bail in connection with Sector- 12 P.S. Case No.16 of 2024 registered for the offences punishable under sections 147/148/149/323/324/307/504/506 of the Indian Penal Code. The Learned counsel for the petitioner submits that this is the second journey of the petitioner for grant of privilege of anticipatory bail and earlier the prayer for grant of privilege of anticipatory bail of the petitioner was rejected vide order dated 06.01.2025 in A.B.A. No. 7980 of 2024. It is next submitted that the fresh ground is that there has been a compromise between the parties and in this respect, learned counsel for the petitioner draws the attention of this Court to the copy of the certified copy of the petition for compromise filed by the parties in the court of Judicial Magistrate 1st Class, Bokaro wherein, it has been mentioned that parties have settled their dispute outside the Court and an amicable settlement has been arrived at between the parties. It is then submitted that the petitioner does not want to proceed with the case and consequent upon such compromise, co-accused persons has already been given the privilege of anticipatory bail by this Court vide order dated 24.03.2025 and 09.04.2025 in A.B.A. Nos.1892 of 2025 and 7890 of 2024 respectively. It is then submitted that the petitioner undertakes to furnish sufficient security including cash security and also undertakes to cooperate with the investigation of the case and further undertakes that he will not annoy or disturb the informant, victims or any of their family members in any manner during the pendency of the case Hence, it is submitted that the petitioner be given the privilege of anticipatory bail. Learned Addl. P.P. opposes the prayer for grant of anticipatory bail. Considering the submissions of the counsels and the fact as discussed above, I am of the opinion that it is a fit case where the abovenamed petitioner be given the privilege of anticipatory bail. Hence, in the event of his arrest or surrender within a period of six weeks from the date of this order, he shall be released on bail on depositing cash security of Rs. 20,000/- and on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Bokaro, in connection with Sector-12 P.S. Case No.16 of 2024 with the condition that the petitioner will cooperate with the investigation of the case and appear before the Investigating Officer as and when noticed by him and will furnish his mobile number and a copy of his Aadhar Card in the court below with the undertaking that he will not change his mobile number during the pendency of the case with further condition that he will not annoy or disturb the informant, victims or any of their family members in any manner during the pendency of the case subject to the conditions laid down under Section 482 (2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
