(Oral) Petitioner herein, who at present is working as Female Health Worker in HWC Badressa, PHC Thona, Block Baldwara, District Mandi, Himachal Pradesh, has approached this Court in the instant proceedings, seeking therein direction to the respondents to consider and decide her pending representation (Annexure P-1), whereby she has prayed for transfer from present place of posting to HWC Salwana, PHC Jarol, Block Rohanda, District Mandi, Himachal Pradesh. 2. Having regard to the nature of prayer and order proposed to be passed in the instant petition, this Court sees no necessity to call for the reply from the respondents, who are otherwise represented by Mr. Ravi Chauhan, learned Deputy Advocate General. It is apparent
from the pleadings adduced on record, which are duly supported by an affidavit that petitioner has been working as Female Health Worker at HWC Badressa, PHC Thona, Block Baldwara, District Mandi, Himachal Pradesh, for more than four years and as such, she is entitled to seek transfer from present place of posting to another station on account of her having completed normal tenure of posting i.e. three years. Most importantly, transfer is being sought on account of adverse family circumstances. If Transfer Policy is perused in its entirety, it clearly provides for transfer of an employee after completion of normal tenure of posting at one station i.e. three years as well as transfer on account of adverse family circumstances. 5. Consequently, in view of the above, this Court, without going into the merits of the case, deems it fit to dispose of the present petition, with a direction to the respondents to consider and decide the pending representation (Annexure P-1) filed by the petitioner expeditiously, preferably within a period of four weeks from today. Ordered accordingly. Needless to say, authority concerned, while doing the needful in terms of instant order, besides affording opportunity of being heard to the petitioner, shall also take of provision contained in Transfer Policy and pass appropriate orders.
