Heard Mr. K. Singha, learned counsel for the petitioner. The instant contempt petition is preferred alleging non-compliance of a direction made in a common Order dated 08.06.2023 passed in the writ petitions, W.P.[C] no. 1838/2022 & W.P.[C] no. 1907/2022. By the common Order dated 08.06.2023, the Court had directed the respondent authorities to carry out a demarcation process in respect of the lands claimed by the petitioners in the two writ petitions. I have perused the contents of the common Order dated 08.06.2023 as well as the pleadings made in this contempt petition where, there is a reference to an incident dated
23.06.2023. Mr. Singha, learned counsel for the petitioner has submitted that the incident occurred on 23.06.2023 was a high-handed action on the part of the respondent Railway authorities. I have heard Mr. Singha, learned counsel for the petitioner at some length. Mr. Singha has submitted that the petitioner will withdraw the instant contempt petition in order to seek appropriate remedy before the appropriate forum against the incident dated
23.06.2023. In view of the above submission made by Mr. Singha, learned counsel for the petitioner,
Page No.# 3/3 the contempt petition is dismissed, as not pressed. Liberty, however, stands reserved to the petitioner to avail appropriate remedy before the appropriate forum as regards the alleged incident dated 23.06.2023.
