03/ 24.04.2025: Heard, learned counsel for the petitioner and learned counsel for the State.
This is an application filed by the petitioner praying for grant of anticipatory bail in terms of Sections 482 and 484 of Bharatiya Nagarik Suraksha Sanhita, 2023 apprehending his arrest for the offences under Sections 126/115/74/85/3(5) of the Bharatiya Nyaya Sanhita (BNS) of 2023 in connection with Kuru P.S. Case No.104 of 2024, pending in the Court of learned Judicial Magistrate-1st Class, Lohardaga.
Learned counsel for the State opposes the prayer for anticipatory bail of the petitioner.
Learned counsel for the petitioner submits that chargesheet has already been submitted against this petitioner on 16.03.2025 being chargesheet No.19 of 2025. Case is under Section 498(A) of IPC where the allegation is the petitioner being the husband used to torture the wife. He submits that he has throughout cooperated in the investigation.
Submission of chargesheet against the petitioner with noting that the petitioner has appeared after notice before the police clearly suggest that they have not felt it necessary to arrest him.
If that be so, I direct the petitioner to appear before the Court below and file appropriate bail bonds.
With the aforesaid observation, the instant anticipatory bail application stands disposed of.
