HIGH COURT OF JUDICATURE AT ALLAHABAD CRIMINAL MISC. ANTICIPATORY BAIL APPLICATION U/S 482 BNSS No. - 8159 of 2025 Court No. - 71 HON'BLE SANJAY KUMAR SINGH, J. Heard learned counsel for the applicant, learned Additional Government Advocate for the State of U.P. and perused the record. This Criminal Misc. Anticipatory Bail Application under Section 482 BNSS has been moved by the applicant after rejecting her anticipatory bail application by the order dated 10.09.2025 passed by Incharge Sessions Judge, Ghaziabad, seeking Anticipatory Bail in Case Crime No. 357 of 2025, under Sections 80(2), 85 BNS and Section 3/4 Dowry Prohibition Act Police Station Loni Border, District Ghaziabad, during pendency of the investigation. As per prosecution case, in brief, complainant Ram Singh, who is father of the deceased Pooja, got an F.I.R. lodged on 03.06.2025 against Triloki Nath, Premwati, Kishanpal, Ravindra, Shivani, Seema (applicant), Komal, Manju and Neeraj, who are husband, mother-in- law, uncle-in-law, brother-in-law, sister-in-law (jethani), sister-in-law (nanad), unmarried sisters-in-law and brother-in-law (nandoi) of the deceased, respectively, stating inter alia that marriage of his daughter with Triloki Nath was solemnized on 21.02.2023 and from their wedlock, a male child was also born. In the marriage, sufficient dowry was given but her in-laws were not satisfied with the dowry. When they came to know that he has sold his plot, they started demanding Rs. 1.5 lacs, due to which, his daughter tried to commit suicide by consuming acid. She was taken to hospital and after recovery of her Versus Counsel for Applicant(s) : Ashish Kumar Pandey Counsel for Opposite Party(s) : G.A. Smt. health, she was discharged from hospital on 01.06.2025 at 07:30 P.M. but again in the night at about 09:00 P.M., her health started deteriorating and she was taken to the hospital but she was declared as brought dead by the doctor. Main substratum of arguments of learned counsel for the applicant is that the applicant is married sister-in-law of the deceased. Her marriage was solemnized in the year 2023 with Mitar and since then she has been living in her matrimonial home bearing H.No. C/7, Gali No. 1, Kabul Nagar, Bahaita, Hajeepur, Ghaziabad. She has no concern with the matrimonial affair of the deceased with her husband Triloki Nath.
No specific role has been attributed to her in the F.I.R. The applicant has no criminal history to her credit and she has apprehension of imminent arrest. Lastly, it is submitted that in case, applicant is released on bail, she would not misuse the liberty and would cooperate with the investigation. Learned A.G.A. representing the State has opposed the prayer for granting anticipatory bail to the applicant but does not dispute the factual aspect of the matter as argued on behalf of the applicant. Looking to the facts of the case, reasonable apprehension of arrest, taking into consideration the gravity and nature of accusation, there being no criminal antecedents of the applicant and there being no possibility of her fleeing from justice, the applicant is entitled to be released on anticipatory bail in this case. In the event of arrest of the applicant Smt. Seema involved in the aforesaid case shall be released on anticipatory bail on her furnishing a personal bond of Rs.25,000/- with two sureties each in the like amount to the satisfaction of the Station House Officer of the police station concerned till the submission of police report, if any, under section 193(3) BNSS with the following conditions :- 1) The applicant shall make herself available for interrogation by a police officer as and when required. 2) The applicant shall not, directly or indirectly make any inducement, NABAIL No. 8159 of 2025 2
