03/ 24.04.2025: Heard, learned counsel for the petitioner and learned counsel for the State.
This is an application filed by the petitioners praying for grant of anticipatory bail in terms of Sections 482 and 484 of Bharatiya Nagarik Suraksha Sanhita, 2023 apprehending his arrest for the offences under Sections 103(i), 238 of BNS, 2023.
Learned counsel for the petitioner submits that save and except confessional statement there is no material against the petitioner, even the confessional statement has got no evidentiary value.
Learned counsel for the State opposes the prayer for anticipatory bail of the petitioner.
Though the petitioner has not been named in the F.I.R. From the impugned order and the materials, I find that a conspiracy was hatched to commit murder of Arjun Singh as he was disturbing the co-accused and others. It has come that co-accused person and others have conspired. The name of this petitioner transpired from the confessional statement of the co-accused as one of the conspirator. Thus, this case needs investigation, even investigation to the extent of taking the petitioner in custody also. I find that this is not a fit case for grant of anticipatory bail to the petitioner. Accordingly, the prayer for anticipatory bail of the petitioner in connection with Khunti P.S. Case No.126 of 2024, pending in the court of learned Chief Judicial Magistrate at Khunti, stands rejected.
