Gogoi, learned counsel for the opposite party Nos. 1 – 5. 2. This application, under Section 5 of the Limitation Act, is preferred by the applicant for condoning the delay of 212 days in filing the substitution petition of the legal heirs of the appellant Abdul Mazid. 3. Mr. Sarma, learned counsel for the applicant submits that the grounds for failing to file the appeal within the stipulated period are explained in Paragraph Nos. 4 & 5 of this interlocutory application and that the delay is not deliberate and Page No.# 5/5 intentional and therefore, it is contended to allow this petition. 4. On the other hand, Mr. Gogoi, learned counsel for the opposite party Nos. 1 – 5 submits that he has no objection in the event of allowing this application. 5. Having heard the submission of learned counsel for the applicant, I have carefully gone through the petition as well as the documents placed on record and also perused the statements and averments made in paragraph Nos. 4 & 5 of the application. 6. It appears that the delay of 212 days is sufficiently explained in the aforementioned paragraphs and therefore, this court is inclined to allow this application and accordingly, the delay of 212 days in filing the substitution petition of the legal heirs of the appellant Abdul Mazid, stands condoned. 7. In terms of above, this I.A. stands disposed of. 8. The Registry shall make necessary corrections in the cause-title of the RSA No. 38/2012 and list the matter in the hearing column after 4 (four) weeks. JUDGE Comparing Assistant
