Order 11/03/2025
1. Apprehending their arrest in connection with FIR No.224/2024 registered at Police Station Kaithwada, District Deeg for the offences under Sections 303(2), 317(2), 319(2), 318(4), 338, 336(3), 340(2), 308(2), 61(2)(a) and 66 of BNS, the accused-petitioners have preferred these anticipatory bail applications under Section 482 BNSS.
2.
Learned counsel for the accused-petitioners submits that the accused-petitioners have falsely been implicated in this case solely on the basis of disclosure statement of the other co-accused. He further submits that the matter is exclusively triable by Magistrate. The accused-petitioners are ready and willing to cooperate and there are no criminal antecedents against the accused-petitioners, therefore, anticipatory bail applications of the accused-petitioners may be allowed.
3. Learned Public Prosecutor vehemently opposes the bail application.
4. Heard and perused the material available on record.
5. Considering the fact that the matter is exclusively triable by Magistrate, the accused-petitioners are ready and willing to cooperate with the investigation and there are no criminal antecedents against the accused-petitioner, without commenting anything on the merits of the case, I deem it just and proper to allow the anticipatory bail applications of the accused-petitioners.
