Kharsawa, Dist- Saraikela- Kharsawan, Jharkhand .... Petitioner(s). Versus The State of Jharkhand … Opp. Party(s). ------ CORAM : SRI ANANDA SEN, J. ------ For the Petitioner(s) : Mr. Bhawesh Kr. Tiwary, Advocate For the State : Mr. Shailesh Kr. Sinha, AddI. P.P. …...... 05/ 04.07.2025: Heard, learned counsel for the petitioner and learned counsel for the State. 2. This is an application filed by the petitioner praying for grant of anticipatory bail in terms of under Sections 482 and 484 of the Bhartiya Nagrik Surksha Sanhita, 2023, has been preferred by the petitioner apprehending his arrest for offences under Sections 317(5) of BNS, Rule 4(1)(A)/21 of MMDR Act and 9 of Jharkhand Minerals (Prevention of Illegal Mining Transportation and Storage) Rule 2017. 3. The learned APP opposes the prayer for anticipatory bail. 4. It is alleged that driver of the vehicle which was commercial vehicle, was carrying 100 cft. of illegally excavated sand. 5. Considering the nature of allegation, which has a severe impact on environment and State exchequer, I find that this is not a fit case for grant of anticipatory bail to the petitioner. 6. Thus, I am not inclined to entertain the anticipatory bail application. Accordingly, the prayer for anticipatory bail of the petitioner in connection with Tamar P.S. Case No.107 of 2024, pending in the Court of learned J.M., Ranchi, stands rejected. (ANANDA SEN, J.) R.S./
