According to petitioner, he purchased land and building, which were mortgaged with State Bank of India, in a public auction. The grievance raised by petitioner is that State Bank of India is neither executing sale deed nor handing over possession of the property purchased by him, even though sale certificate was issued in his favour on 16.02.2023. 4. By means of this writ petition, petitioner has sought the following relief:- (i) issue a writ, order or direction in the nature of mandamus, commanding/directing the respondent no. 1 to execute sale deed and given the possession of land & building, bearing Municipal No. 2/5, admeasuring 32.98 sq.mt,. situated at Ka Juj, Darona Sagar Road, Kashipur, District Udham Singh Nagar, to the petitioner. 5. Since petitioner has sought a writ of mandamus and he has also approached the Competent Authority by making formal demand, therefore, this Court thinks that ends of justice would be met, if petitioner is permitted to make fresh representation to the Competent Authority. 2025:UHC:7940 6. Accordingly, the writ petition is disposed of by permitting petitioner to make fresh representation to Authorised Officer (respondent no. 1) with a request to execute a sale deed and also to handover possession of the property in question to him. If petitioner makes such representation within ten days from today, the Authorised Officer shall look into the matter and take appropriate decision, by passing a reasoned order, within four weeks from the date of receipt of such representation along with certified copy of this order.
