[2025:RJ-JP:13371] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous 2nd Bail Application No. 3413/2025 Jodhraj S/o Bherulal, Aged About 32 Years, R/o Village Laxmipura, Police Station Nainwa, District Bundi (Raj.) (At Present In District Jail Bundi). ----Petitioner Versus State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : Mr. K.N. Sharma For Respondent(s) : Mr. Tapesh Agarwal, PP HON'BLE MR. JUSTICE SUDESH BANSAL Order 25/03/2025 1. This second bail application has been filed by petitioner under Section 483 of the BNSS in connection with FIR No.276/2023 registered at Police Station Nainwa, District Bundi for offence(s) under Sections 147, 148, 149, 447, 307 and 302 IPC. 2. It has been argued by counsel for the petitioner that petitioner is in custody since 27.07.2023; in the prosecution evidence, about 14 witnesses have been examined out of 70 witnesses and other co- accused have been released on bail, hence, petitioner be released on bail. 3. Having heard learned counsel for the petitioner as well as learned Pubic Prosecutor and perused the record, it appears there is direct allegation against the petitioner to trample the tractor over the head of deceased Sanju Bai, due to which she died on the spot. Petitioner is the main accused in the present case, hence, considering the allegation [2025:RJ-JP:13371] (2 of 2) [CRLMB-3413/2025] against the petitioner and more particularly, the statements of Prahlad- husband of deceased (PW-11), this Court is not inclined to release the petitioner on bail at this stage. 4. Accordingly, the second bail application is dismissed. (SUDESH BANSAL),J NITIN /2
