01. Proceedings in the present criminal contempt petition have been initiated on a reference made by the learned Chief Judicial Magistrate, Jammu, in case titled Lal Zohra Vs. Kuldeep Khajuria.
02. The learned Trial Court was of the opinion that the respondent- Kuldeep Khajuria, who was posted as SHO, had tendered wrong information to the Court and also concealed final order dated 02.12.2013, as such, was prima facie guilty of criminal contempt of Court under J&K Contempt of Courts Act. Accordingly, contempt proceedings were sought to be initiated against him.
03. Notice in this contempt petition was issued on28.05.2016. Pursuant to the same, the respondent/alleged contemnor has filed his response. In his response, the respondent/alleged contemnor has tendered unconditional apology on account of lapse on his part and has expressed profound regret for the same. The omission by the respondent to produce
the order dated 02.12.2013 before the Court was not deliberate rather the same could not be produced as it was not in the file and he had no information regarding the same. He expresses his profound regret for the lapse which has occurred due to this omission.
04. Today also, respondent is present in person and again tenders unconditional apology and submits that he upholds the majesty of law and holds it in high esteem.
05. Mr. Aseem Sawhney, learned Senior Counsel,has no objection to the submissionsmade by the respondent.
06. In view of the aforesaid facts and considering that the respondent has tendered an unconditional apology, which is genuine, bona fide and in good faith and the respondent has also submitted that he has firm belief in the majesty of law.Therefore, with a view to put aquietus to the proceedings which are pending since 2016, the apologytendered by the respondent is accepted.
07. Accordingly, the proceedings in this contempt petition are closed.
