Singha for the petitioner Fatik Das who has filed this application under Section 482 of the BNSS, 2023 praying for pre-arrest bail apprehending arrest in connection with Dispur PS Case No. 235/2025 under Section 61(2)/111(2) (a)/308 (5)/336 (3)/340 (2) of the BNS, 2023. Page No.# 2/2 2. Learned Addl.Public Prosecutor Mr. B. Sharma is present for the State respondent. 3. It is submitted on behalf of the petitioner that he is the sitting lessee of Beltola Bi weekly market and his term has been completed on 13.03.2025. Now new tender will be floated presumably on 06.04.2025. The petitioner is apprehending that some interested persons are against the petitioner‘s extension as lessee and have been acting in connivance to restrain the petitioner from participating in fresh tender. Police is searching for the petitioner. It is submitted that the petitioner is not involved in collecting toll from the poor vendors at Beltola. He is legally collecting as sitting lessee. 4. I have considered the submissions at the Bar with circumspection. 5. I have scrutinized the Case Diary. The petitioner has appeared before the Investigating Officer and his statement has been recorded. 6. I have considered the submission on behalf of the petitioner that the petitioner is willing to co-operate with the remaining part of investigation. 7. The petitioner has not violated any bail conditions. Thereby, the interim order dated 04.04.2025 is hereby made absolute under the same terms and conditions. 8. Send back the Case Diary.
