Neutral Citation No. - 2025:AHC:23778-DB Court No. - 29 Case :- WRIT - C No. - 33842 of 2024 Petitioner :- Munni Devi Respondent :- State Of Up And 6 Others Counsel for Petitioner :- Vidya Kant Tripathi Counsel for Respondent :- C.S.C. Hon'ble Ashwani Kumar Mishra,J. Hon'ble Arun Kumar Singh Deshwal,J. Petitioner has approached this Court with the grievance that the local police officials have coerced her to remove her Thela (Cart) and has instead allowed private respondent nos.6 and 7 to put their Cart/stall on the same place. Instructions were invited from the concerned respondents. The instructions received by learned Standing Counsel is produced before the Court, which is taken on record. Its copy has also been given to the counsel for the petitioner. The instructions clearly states that Cart was being put on a private land of Ashram, which is being managed by one Ashutosh @ Monu and that a compromise has been worked out between the petitioner and the owner. It is also stated that none of the State Authorities have interfered in the occupation and running of the Cart/stall of the petitioner. From the materials placed on record, we find that there is a private dispute between the petitioner and the owner of the land, in respect of which a writ petition would not be maintainable, at the first instance. Leaving it open for the petitioner to approach the competent civil court for necessary relief, this writ petition is consigned to records.
