The present Application under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been preferred by the applicants - accused for quashing the entire proceedings of Criminal Case No. 693 of 2019, “State vs. Santosh Singh and Others”, pending before the court of Additional Chief Judicial Magistrate, Rishikesh, District Dehradun. 2. Subsequent to the submission of the charge- sheet, the learned Magistrate took cognizance and passed the summoning order against the applicants under Sections 498A, 504, 323 of the Indian Penal Code, 1860, Section 3 and Section 4 of the Dowry Prohibition Act, 1961. 1 2025:UHC:7347 3. Mr. Vaibhav Singh Chauhan, learned counsel for the applicants, Mr. Pradeep Lohani, learned Brief Holder for the respondent no.1 and Mr. Ankur Sharma, learned counsel for the respondent no.2/informant. 4. The applicant no.1- Santosh Singh alias Santosh Bisht, the husband of the informant, the applicant no.2- Rajendra Singh alias Rajendra Bisht, the father of the applicant no.1, the applicant no.3- Smt. Rameshwari Devi, the mother of the applicant no.1, and, the applicant no.4- Usha, the real sister of the applicant no.1, are present in- person before this Court. They are identified by Mr. Vaibhav Singh Chauhan, Advocate. 5. Smt. Kavita Rawat, the informant/ respondent no.2, is present in-person before this Court. She is identified by Mr. Ankur Sharma, Advocate. 6. Both, the applicants and the respondent no.2 submitted that they have settled their disputes amicably and reached to compromise pursuant to which they have filed a Compounding Application (IA No.01 of 2025) with their affidavits. They submitted that they have filed the compounding application and affidavits with their free will and without any pressure. They have requested to quash the entire proceedings of Criminal Case No.693 of 2019. 2 2025:UHC:7347 7. Learned counsel for the State submitted that the matrimonial disputes have been settled amicably, therefore, the State has no objection to the submissions of the applicants and the respondent no.2. 8. Considering the totality of the matter, this Court is of the view that ends of justice would be met if the entire proceedings of Criminal Case No. 693 of 2019, “State vs. Santosh Singh and Others”, pending before the court of Additional Chief Judicial Magistrate, Rishikesh, District Dehradun, are quashed. 9. Resultantly, the present Application filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 is allowed and the entire proceedings of Criminal Case No. 693 of 2019, “State vs. Santosh Singh and Others”, pending before the court of Additional Chief Judicial Magistrate, Rishikesh, District Dehradun, are hereby quashed. ___________________ ALOK KUMAR VERMA, J.
