HIGH COURT OF JUDICATURE AT ALLAHABAD WRIT - A No. - 14857 of 2025 Court No. - 4 HON'BLE AJIT KUMAR, J. Heard Ms. Haya Rizvi, learned counsel for the petitioner as well as learned Standing Counsel. By means of this petition filed under Article 226 of the Constitution, petitioner has prayed for writ of Mandamus commanding the respondent nos. 2 and 3 not to force the petition to vacate the official accomodation which is in her possession at Ghaziabad. It is considered that although the petitioner has been transferred on 31.05.2025 from Ghaziabad to Gautam Buddh Nagar but she wants to continue to retain the official accommodation as she is having two small children and she will get them admitted to the school at Gautam Buddh Nagar in the next academic session. Per contra, it is argued by learned Standing Counsel that the petitioner being a lady Constable in UP Police since has to look after the children it could not be easy for her to visit everyday from Ghaziabad to Gautam Buddh Nagar just to retain an official accommodation and she should apply for official accommodation at Gautam Buddh Nagar itself. Having heard learned counsel for the respective parties and having perused the records. Since the petitioner is ready to accommodate herself while keeping as a daily commuter from Ghaziabad to Gautam Buddh Nagar to look after her children staying at Ghaziabad in an official accommodation which she wants Versus Counsel for Petitioner(s) : Haya Rizvi Counsel for Respondent(s) : C.S.C. Vineeta Rathi .....Petitioner(s) State Of U.P. And 2 Others .....Respondent(s)
to retain only till the next academic session, and since she has also made a representation in this regard on 15.09.2025, I consider it appropriate for the authority to take decision in the matter and until such decision is taken petitioner may not be forced to vacate the official accommodation.
Learned Standing Counsel submits that the competent authority in the matter is respondent no.2 In view of the this petition is disposed of with a direction to respondent no.2 to look into and consider the grievance of the petitioner raised in her representation dated 15.09.2025 and pass appropriate orders regarding retention of the official accommodation at Ghaziabad as expeditiously as possible preferably within a period of one month from the production of certified copy of this order and until such decision is taken, petitioner shall not be forced to vacate the official accommodation at Ghaziabad.
