Heard the learned counsel for the petitioners and the learned Assistant Government Pleader appearing for the State. 2. The learned counsel for the petitioners submits that the petitioners were arraigned as A2 and A.3 in Crime No.13 of 2025 of Mahila UPS, Visakhapatnam, for the alleged offences under Sections 85, 351(2) of the Bharatiya Nyaya Sanhita and Sections 3 and 4 of the Dowry Prohibition Act, 1961. 3. The learned counsel further submits that the 1st petitioner is the father- in-law and the 2nd petitioner is the mother-in-law of the 2nd respondent. -2- CRL.P. No.2568 OF 2025 The marriage of the 2nd respondent with A.1/the son of the petitioners was performed on 07.02.2004. On account of certain marital disputes, the 2nd respondent filed a complaint against the petitioners and her husband/A.1. The 2nd respondent also filed F.C.O.P. No.1743 of 2024 before the Additional Family Court, Visakhapatnam. The petitioners have never stayed with A.1 and the 2nd respondent, and they have no role in the alleged commission of the offence. 4. Considering the submissions of the learned counsel for the petitioners, this Court deems it appropriate to direct the Station House Officer, Mahila UPS, Visakhapatnam, to follow the procedure as contemplated under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023, for the purpose of investigation in connection with Crime No.13 of 2025, insofar as the petitioners is concerned. 5. Accordingly, the criminal petition is disposed off. 6. Miscellaneous petitions, if any, pending in this criminal petition shall stand closed. ____________________ JUSTICE HARINATH.N BV
