This Criminal Petition, under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘the BNSS’) has been filed on behalf of the petitioner/accused No.3 to grant anticipatory bail in connection with Crime No.53 of 2024 of Special Enforcement Bureau Police Station, Paderu, Allurisitharama Raju District, registered for the offence punishable under Section 8 (c) read with 20 (b) (ii) (C) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short ‘the NDPS Act’).

Brief facts of the case are that, on 13.02.2024 the Sub-Inspector of DTF SEB, Paderu, along with his personnel, was conducting vehicle checking at Chinthalaveedhi, Village Junction, Paderu Mandal; that they noticed one vehicle with heavy load coming towards them, and on seeing the police personnel, the vehicle was stopped at a distance of 100 meters and out of the two persons in the vehicle, one of the persons, who sat beside the driver, tried to run away; that the police apprehended both the persons, who are accused Nos.4 and 5 in the subject crime; that on inquiry, they confessed that with the assistance of accused Nos.1 to 3, they were transporting ganja; that on verification by the police, the vehicle was found loaded with 18 bags containing 732
3 kgs of Ganja. The police seized the contraband along with the aforesaid vehicle under the cover of a Mediators Report, registered the aforesaid crime and arrested the accused Nos.4 and 5 for the aforesaid offences and investigated into.

Learned counsel for the petitioner/accused No.3 submits that the petitioner is no way connected with the alleged offence and he is falsely implicated in the present crime basing on the confession made by the co-accused. He further submits that the police personnel are trying to apprehend the petitioner/accused No.3 and extract confessional statement from him. According to the learned counsel for the petitioner/accused No.3, most of the investigation is completed except filing of the charge sheet.

On the contrary, learned Assistant Public Prosecutor submits that the contraband that is seized in the present case is about 732 kgs of Ganja, and police seized one vehicle which was used for transporting the contraband, from the possession of accused. According to learned Assistant Public Prosecutor, investigation is not yet completed.

6. A perusal of material on record goes to show that huge quantity of Ganja weighing 730 kgs and odd was seized from
4 the possession of accused Nos.4 and 5, who were allegedly transporting the contraband with the assistance of accused Nos.1 to 3, on the date of the incident. The investigation is at nascent stage, therefore, the petitioner/accused No.3 is not entitled to anticipatory bail.
7. Accordingly, the Criminal Petition is dismissed.
As a sequel thereto, the miscellaneous petitions, if any, pending in this Criminal Petition, shall stand closed.
