CMP.M No. 1694 of 2022 & CMP No. 5475 of 2023 By way of CMP No. 5475 of 2023, filed by the respondent, it has been brought to the notice of the Court that the Civil Suit filed by the present petitioner i.e. Civil Suit No. 161-1/2017, titled Arun Sharma & anr. Vs. Sushma Devi, has been dismissed by the Court of learned Civil Judge, Court No.II, Amb, District Una, on 30.12.2022. Further, in the light of the fact that CMPMO No. 774 of 2019 itself was withdrawn by the petitioner, though an observation was made therein by the Hon’ble Coordinate Bench while allowing the petitioner to withdraw the petition that the application filed under Order XXXIX, Rule 2-A of the Code of Civil Procedure shall be decided on merit, but taking into consideration the fact that the main suit filed by the petitioner itself has been dismissed, this Court sees no reason to dwell upon the merits of the application filed under Order XXXIX, Rule 2-A of the Code of Civil Procedure, in the peculiar facts of the case.
