Counsel for the Respondent/complainant(S): Ld. Public Prosecutor The Court made the following order:
1. Heard the learned counsel for the petitioners and the learned Assistant Government Pleader appearing for the State.
2. The learned counsel for the petitioners submits that the petitioners were arraigned as A.2 to A.5 in Crime No.29 of 2025 of Mahila Urban Police Station, Guntur, for the alleged offences under Sections 85, 351(2) of the Bharatiya Nyaya Sanhita, 2023 and Sections 3 and 4 of the Dowry Prohibition Act, 1961.
3. The learned counsel further submits that the 1st petitioner is the mother- in-law and the 2nd petitioner is the father-in-law, 3rd petitioner is sister-in- law of the 2nd respondent and the 4th petitioner is husband of the 3rd
-2- CRL.P. No.2537 OF 2025 petitioner. The marriage of the 2nd respondent with A.1/the son of the petitioners 1 and 2 was solemnized on 09.05.2007. On account of certain marital disputes, A.1 and the 2nd respondent have been staying away for the last five years and A.1 also filed F.C.O.P. No.230 of 2022 before the II Additional District & Sessions Judge-cum-I Additional Family Court, Medchal and on account of non-appearance of the 2nd respondent, an ex-parte decree was granted. It is further submitted that the 2nd respondent, after having come to know about the divorce, has filed a false complaint.
4. Considering the submissions of the learned counsel for the petitioners, this Court deems it appropriate to direct the Station House Officer, Mahila Urban Police Station, Guntur, to follow the procedure as contemplated under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023, for the purpose of investigation in connection with Crime No.29 of 2025, insofar as the petitioners is concerned.
5. Accordingly, the criminal petition is disposed off.
6. Miscellaneous petitions, if any, pending in this criminal petition shall stand closed. ____________________ JUSTICE HARINATH.N BV
