Heard Shri Devashish Mitra, learned counsel for the applicants, learned A.G.A. for the State and Shri Ashish Dwivedi, learned counsel for opposite party No.2. 2. This application under Section 482 Cr.P.C. has been filed challenging the proceedings of Criminal Case No.438 of 2020 (State vs. Nirpendra and others), arising out of Case Crime No.294 of 2017, under Section 420 and 506 I.P.C. and Section 53 of U.P Sugarcane (Regulation, Supply and Purchase) Act 1953, Police Station-Qyoladiya, District-Bareilly. 3. Office report dated 10.03.2025 indicates that verification report has been received. A copy of order dated 06.01.2025 passed by the learned Judicial Magistrate, Nawabganj, Bareilly verifying the compromise dated 05.12.2024 has also been produced which is taken on record. 7. Considering the submissions made and in view of the law laid down in Gian Singh vs. State of Punjab and another: (2012) 10 SCC 303 and Nikhil Merchant vs. Central Bureau of Investigation : (2008) 9 SCC 677 and considering the nature of offence, this Court is of the view that once prosecution itself has chosen not to pursue the matter and is satisfied with the terms of amicable settlement, no fruitful purpose would be served in continuance of the proceedings of the aforesaid case.
