Satyanarayana Moorthy CORAM : THE CHIEF JUSTICE DHIRAJ SINGH THAKUR SRI JUSTICE RAVI CHEEMALAPATI DATE : 11th February 2025 P C : By virtue of an order, dated 15.03.2022, interim order was passed directing status quo be maintained with regard to the property in question subject to payment of Rs.30,00,000/- to the respondent Bank within a period of two weeks. 2. Learned counsel for the petitioners states that the amount was deposited within the time prescribed. 3. On a perusal of the order, dated 15.03.2022, it can be seen that the Court had observed that there was no regular presiding officer in the Debts Recovery Tribunal at Visakhapatnam and that was perhaps the reason why the Court was inclined to direct the maintenance of status quo. 4. However, since there is a presiding officer available in the Debts Recovery Tribunal which is fully functional, the petitioners can avail the alternate remedy by way of an appeal. 5. Be that as it may, in view of the judgment rendered by the Apex Court in the case of United Bank of India Vs. Satyawati Tondon1, we are not inclined to exercise our writ jurisdiction under Article 226 of the Constitution of India. 6. The order of status quo, however, shall remain in operation for a period of two (2) weeks from today. During which time, the petitioners would be well advised to avail the alternate remedy. 7. This writ petition is, accordingly, disposed of. No costs. Consequently, connected miscellaneous applications, if any, including amendment petitions are closed.
