Sri Diwan Saifullah Khan, learned counsel for the applicant and Sri Ashwani Kumar Rai, learned A.G.A. for the State are present. The present application under Section 482 of the Code of Criminal Procedure, 1973 has been filed to quash the entire proceedings of Criminal Case No. 888 of 2014, (State of U.P. Vs. Ved Prakash) arising out of Case Crime No. 447 of 2013, under Section 354-ka of I.P.C., Police Station- Ghaziabad Kotwali, District- Ghaziabad, as well as charge-sheet dated 06.09.2013 pending in the Court of Additional Chief Judicial Magistrate, Court No. 6, Ghaziabad. The delay in filing of the present application is explained. After some arguments, learned counsel for the applicant does not want to press this application and wants liberty to file an appropriate application/ proceedings before the court of competent jurisdiction. Certified copy of the order may be returned to the learned counsel for the applicant after retaining a xerox thereof.
