(2) Petitioner is aggrieved by demolition order dated 30.7.2025, passed by Joint Secretary, District Level Development Authority, Haldwani. Said order has been passed under Section 27 of Uttarakhand Town and Urban Planning and Development Act, 1973. (3) Learned Counsel for the petitioners submits that petitioners are registered owners of the building, in question, and it was purchased by them through a registered sale deed dated 2.6.2020. He submits that without giving notice to registered owners, the demolition order has been passed. He further submits that notice appears to have been issued to one Mr. Naseem Ahmed, who has no relation with the building in question. He further submits that coordinate Bench of this Court, in Writ Petition (M/S) No. 2410 and 2413 of 2025 has permitted the petitioners to approach the competent authority by filing recall application. He submits that similar order be passed in the present case also. (4) Ms. Ananya Jain, learned Counsel appearing for District Level Development Authority, concedes that similar order was passed by coordinate Bench in the aforesaid 2025:UHC:7286 writ petitions. (5) In such view of the matter, writ petition is disposed of granting liberty to petitioners to move an application seeking recall of the demolition order dated 30.7.2025. If petitioners make such application within one week from today, the competent authority shall consider the prayer made by petitioners and pass appropriate order, as per law, within two weeks thereafter. (6) For a period of three weeks or till the disposal of recall application, whichever is earlier, there shall be status quo qua the building in question.
