Petitioner is aggrieved by an order passed by the Chief Development Officer, Varanasi, dated 25.06.2024, rejecting petitioner's representation in respect of construction of approach road (paved road) to petitioner's premises. 2. It appears that petitioner has established some industry, which is situated nearly 300 mtrs. from the main road. There is already a Chak Road to connect petitioner's premises from main road. 3. The instructions obtained by the State Counsel clearly states that there was no Abadi near petitioner's premises and in the absence of any funds available or resolution of Gaon Sabha, it is not feasible to construct paved road in place of Chak Road. 4. The photographs annexed clearly show existence of Chak Road, which is to facilitate the passage of villagers including the petitioner. Merely because petitioner has raised some construction on agricultural land, it does not become obligatory for the State to construct paved road to facilitate petitioner's transit. In the absence of there being any resolution of the Land Management Committee or Gaon Sabha and availability of funds, no direction can be issued to convert Chak Road, existing for facilitation of farmers, into a paved road for petitioner's convenience. 5.
