The petitioners have filed the present petition claiming the following reliefs:- “Civil writ petition under Article 226 of the Constitution of India praying for issuance of a writ in the nature of mandamus directing the respondents to release the benefit of adhoc service w.e.f. 16.05.1987 and 1.08.1989 to the petitioners as admitted having worked from these dates as per Annexure P-1 and P-9 dated 24.03.09 and 24.03.09, releasing the benefit of fixation of pay in the revised pay scale w.e.f. 1.01.2016 whereas the last basic pay drawn as per Pension Payment Order Annexure P-5 and P-11 dated 28.04.25 and 18.03.2025 was taken for fixation of pension without adding Dearness allowance applicable on 30.04.2022 as per 6th pay Commission, release of leave encashment to both the petitioners in AMIT RANA 2025.09.22 17:34 I attest to the accuracy and authenticity of this judgement/order CCCCW W W WPPPP 22228888000022228888 ooooffff 2222000022225555 ----2222---- view of the Hon'ble Supreme Court of India decision dated 18.11.24 passed in Civil Appeal No.17529-17530 of 2017 and lastly a direction for release of interest on the delayed payment of pension/death cum-retirement gratuity for more than 3 years. It is further prayed that petitioners pay be revised as per revision w.e.f. 01.01.2016, by giving benefit of adhoc service prior to 01.08.1995 and refixing the pension, gratitude and release of leave encashment with all consequential benefits including interest be released”. 2. Learned counsel for the petitioners submits that the petitioners have already served a legal notice dated 05.06.2025 (Annexure P-8) on the respondents but the respondents have not conveyed any decision so far. Learned counsel for the petitioners further submits that he shall be satisfied in case the appropriate directions are issued to respondent No.2 to decide the legal notice dated 05.06.2025 (Annexure P-8) in a time bound manner. 3. On the asking of the Court, Mr. Satnam Preet Singh Chouhan, DAG, Punjab, who is present in the Court, accepts notice on behalf of the official respondents and has no serious objection to the limited prayer made by learned counsel for the petitioners, at this stage. 5. I have heard learned counsel for the parties and perused the record carefully. 6.
