Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record. 2. By means of the present application under Section - 529 B.N.S.S., the applicant has sought for a suitable direction to learned Additional/Special Judge (Pocso Act) District -Mirzapur to expedite the proceedings and to decide the S.T No. 705 of 2022 (State V/S Ashish kumar Biyar @ Golu), arising out from the Case Crime No. 199/2021, under Sections 363, 366, 376 I.P.C. & 3(2) (v) S.C/S.T.Act, at Police Station Adalhat, District-Mirzapur, which is pending before the learned Additional/Special Judge (Pocso Act) District -Mirzapur, within time stipulated by this Court. 3. It is submitted by learned counsel for the applicant that applicant is accused in the aforesaid case, which is pending since the year 2022 but no substantial progress has been made in the trial so far and that even the charges have not been framed against applicant. It was submitted that right of speedy trial is part of fundamental right and thus a direction may be issued to the concerned Trial court to decide the aforesaid case within specific time frame. 4. In view of aforesaid, the Trial court concerned is directed to expedite the proceedings of the aforesaid case and to decide the same as early as possible, preferably within a period of six months from the date of production of copy of this order before the court concerned, provided there is no legal impediment. 5. The application under Section 529 B.N.S.S. is disposed of accordingly.
