The learned counsel for the petitioners submits that the petitioners were arraigned A.1 and A.2 in Crime No.376 of 2024 of Pedakakani Police Station for the alleged offences under Sections 69, 115(2), 79, 351(2) of the Bharatiya Nyaya Sanhita, 2023 (for short ‘B.N.S.’). 3. The learned counsel further submits that the petitioners are son and father by relationship. It is further submitted that as per the allegations in the complaint, the 1st petitioner and the 2nd respondent were in a relationship for some time, and their affair had gone sour. On account of -2- CRL.P. No.2564 OF 2025 the differences, the 2nd respondent filed a complaint arraigning the petitioners as the accused. The sole allegation against the 2nd petitioner is that he verbally abused the 2nd respondent/de facto complainant, which does not appear to constitute an offence under Section 69 of B.N.S. The learned counsel submits that there is absolutely no truth in the complaint. Even as per the complaint, the alleged offence occurred much prior to the date of the complaint. 4. Considering the submission that the allegation against the petitioners would not constitute the offence under Section 69 of B.N.S., this Court is inclined to direct the Station House Officer, Pedakakani Police Station, Guntur District, to follow the procedure as contemplated under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023, insofar as the 2nd petitioner is concerned. 5. With these observations, the criminal petition is disposed off. 6. Miscellaneous petitions, if any, pending in this criminal petition shall stand closed. ____________________ JUSTICE HARINATH.N BV
