Present civil writ petition has been filed under Article 226 of the Constitution of India for issuance of a writ in the nature of certiorari seeking quashing of the order dated 23.07.2024 (Annexure P-9), vide which claim of the petitioner for family pension stands rejected and further to issue a writ in the nature of mandamus directing the respondents to grant the family pension and all the retiral benefits, including gratuity, provident fund, leave encashment etc. to the petitioner along with interest @18% per annum. 2. Learned counsel for the petitioner submits that at this stage, the petitioner would be satisfied, if the legal notice dated 15.05.2025 (Annexure P-10) served upon the respondents is decided by respondent No.2, by passing a speaking order, after affording an opportunity of hearing, in a time bound manner. In view of the limited prayer made by learned counsel for the petitioner, present petition is disposed of and respondent No.2 is directed to consider and decide the legal notice dated 15.05.2025 (Annexure P-10) and pass a speaking order, after affording an opportunity of hearing to the petitioner, within a period of three months from the date of receipt of certified copy of this order. 6. Further, the decision taken on the legal notice dated 15.05.2025 (Annexure P-10) shall be conveyed to the petitioner. 7. Needless to say, if the petitioner is found entitled to the relief sought, the same be granted to her forthwith by the competent authority.
