Side) ORDER Earlier, this Court by an order dated 05.08.2025 directed the petitioners to appear before the learned Judicial Magistrate, Vanur on or before 15.09.2025 and on their appearance, the learned Judicial Magistrate, Vanur is directed to complete the committal proceedings after serving notice as contemplated under Sec.207 of Cr.P.C. and if the petitioners fails to appear on or before 15.09.2025, the look out circular and the red corner notice shall stand automatically restored. Now, this petition has been filed seeking for extension of time. 2. Today, when the matter taken up for hearing, the learned counsel appearing for petitioners submitted that they are permanently settled down at USA and their daughters are also studying at USA. Further, they are suffering from various health issues and taking regular treatment at USA. The 1 st petitioner is having spinal card problem and he cannot sit continuously for more than 30 minutes, due to which, he lost his job. He would also submit that as the 2/5 https://www.mhc.tn.gov.in/judis CRL MP No. 17350 of 2025 flight tickets are very high, they are not in a position to afford the same. Hence, they could not comply the condition imposed by this court. Therefore, they have filed this petition seeking for extension of time for the period of four months. 3. The learned Government Advocate (Crl. Side) appearing for respondent raised strong objections stating that totally 14 accused involved in this case and due to their non-appearance, entire P.R.C. Proceedings are stalled, since the alleged incident happened in the year 2018. 4. On seeing the facts, it reveals that as the alleged offence happened in the year 2018, all these years, they have not appeared and not cooperated with the committal proceedings. Hence, already the matter was split up by the trial court. Since the incident was happened five years back, due to their non- appearance, the proceedings were stalled, however they are in abroad. Therefore, to give one more opportunity to them to comply the order and to take steps to complete the visa process, this Court is inclined to extend the time for the period of two months for complying the order passed by this court in Crl.R.C.No. 1172 of 2025.
