The present writ petition has been filed challenging the impugned First Information Report dated 02.09.2025 lodged as Case Crime No. 504 of 2025, under Sections 318(4), 338, 336(3), 340(2) of The Bharatiya Nyaya Sanhita, 2023, Police Station Nawabganj, District Bareilly. It has been argued by the counsel for the petitioner that the First Information Report has been lodged with the mala-fide intention to harass the petitioner as there is a property dispute between the parties. It has been argued that for the aforesaid reason the first information report is liable to be quashed. The AGA has opposed the petition. It would not serve any useful purpose to keep the writ petition pending. In the circumstances of the case and after considering the rival submissions of the counsel for the parties, the writ petition is disposed of with a direction that the petitioner shall not be arrested in pursuance to the First Information Report dated 02.09.2025 lodged as Case Crime No. 504 of 2025, under Sections 318(4), 338, 336(3), 340(2) of The Bharatiya Nyaya Sanhita, 2023, Police Station Nawabganj, District Bareilly till submission of the police report under Section 193 of Bhartiya Versus Counsel for Petitioner(s) : Ajay Kumar Sharma, Atul Sharma Counsel for Respondent(s) : G.A.
