This application has been filed under Section 24 CPC for transfer of Suit No. 74 of 2021 from Family Court, Nainital to Family Court, Almora. The said suit for divorce has been filed by respondent (husband) under Section 27 of Special Marriage Act at Nainital. 3. Learned counsel for the applicant submits that the marriage was solemnised between the parties on 04.04.2014, and a son was born out of the wedlock, who is now about 10 years old. 4. It is contended that applicant is residing with her parents at Dwarahat, District Almora; applicant is without any source of income, and no maintenance is being paid by respondent; applicant is disabled person, and as per disability certificate, her disability is to the extent of 60%. 5. Mr. Prabhakar Joshi, learned counsel appearing for the respondent submits that respondent is serving as Conductor in Uttarakhand Transport Corporation and divorce suit was filed in 2021, therefore, if the case is transferred from Nainital to Almora, then the Court concerned be directed to decide the suit at an early date. 2025:UHC:3979 6. For the aforesaid facts and reason, I allow the Transfer Application. 7. The proceedings of Suit No. 74 of 2021 are transferred from Family Court, Nainital to Family Court, Almora (Camp at Ranikhet). 8. Needful be done by both the Courts below as early as possible. 9. Registry is directed to communicate this order to both the Courts below within 48 hours. 10.
