HIGH COURT OF JUDICATURE AT ALLAHABAD WRIT - A No. - 14818 of 2025 Court No. - 4 HON'BLE AJIT KUMAR, J. Heard learned counsel for the parties and perused the records. By means of this petition filed under Article 226 of the Constitution, petitioner has prayed for following relief as substantial relief: " Issue a writ, order or direction in the nature of mandamus directing the respondent no.3 to consider the compassionate appointment of the petitioner on the post of ward boy under UP Recruitment of Dependents of Government Servant Dying in Harness Rules, 1974 in accordance with law." It is argued by learned counsel for the petitioner that the father of the petitioner while serving with the respondent's establishment died on 22nd March, 2024 and consequently petitioner has moved an application seeking compassionate appointment on 12.06.2024 and the same has remained undisposed of. Learned Standing Counsel has no objection in the event petitioner claims for compassionate appointment is directed to be disposed of by the respondent no.3 in accordance with law. In view of the above, this petition stands disposed of with a direction that respondent no. 3 shall consider the claim of the petitioner for compassionate appointment raised in his application dated 12.06.2024 and decide the same in light of the judgment of Malaya Nanda Sethy v. State of Orissa and others, 2022 SCC OnLine SC 684, as expeditiously as possible positively within a period of two months from the date of receipt of certified copy of this order. It is further provided that in the event the Versus Counsel for Petitioner(s) : Kalpna Upadhyay, P.K. Upadhyay Counsel for Respondent(s) : C.S.C. Sandeep Kumar Mishra .....Petitioner(s) State Of U.P.
