By way of filing this petition, a challenge has been led to the impugned order dated 18.07.2012 passed by the respondent by which the appeal preferred by the petitioner against the impugned order dated 12.06.2012 has been rejected on the ground of being barred by limitation. 2. None has put appearance on behalf of both the parties. 3. Perusal of the record indicates that the services of the petitioner were terminated by the respondents while passing the impugned order dated 12.06.2012 against which an appeal was preferred by the petitioner on 16.07.2012. The Appellate Authority [2025:RJ-JP:7760] (2 of 2) [CW-1079/2013] has rejected the aforesaid appeal vide order dated 18.07.2012 of the petitioner not on merits but on technical count that the same was preferred after a delay of 15 days. The delay in filing the appeal was well explained by the petitioner, which has not been taken into consideration and the order impugned has been passed by the Appellate Authority. 4. In view of the above, the instant writ petition stands disposed of. The impugned order dated 18.07.2012 is quashed and set aside. The matter is remitted back to the Appellate Authority to decide the appeal of the petitioner on its merits expeditiously as early as possible preferrably within a period of three months from the date of receipt of certified copy of this order, after affording due opportunity of hearing to the petitioner as well as the respondent strictly in accordance with law. 5. Since the parties are not aware about passing of this order, office is directed to send a copy of this order to the petitioner as well as the respondent on their addresses mentioned in the memo of cause title of the petition. 6. Pending application(s), if any, shall stand disposed of. (ANOOP KUMAR DHAND),J NEERU/86
