Contention of learned counsel for the applicant is that though in the FIR, allegations have been made against the applicant along with his father for beating mercilessly to the injured Neelam for non-fulfillment of demand of dowry but all the injuries are simple in nature except one injury which is fracture in fimer. It is further submitted that the applicant is in jail since 24.04.2025 and he has been falsely implicated. Charge sheet has been filed by the police, therefore, there is no requirement for custodial interrogation. In case, he is granted bail, he will not misuse the liberty of bail and would cooperate in the trial proceedings. 4. Per contra, learned A.G.A. for the State opposed the prayer for bail and submitted that prior to lodging of the FIR in question, another FIR was lodged by the injured victim for harassment due to demand of dowry. On compromising with the injured, who is wife of the applicant, injured did not pursue the earlier case and the same is pending before the trial court, therefore, the incident in question was again occurred in which the victim Versus Counsel for Applicant(s) : Bharat Singh Counsel for Opposite Party(s) : G.A. Neelam was beaten mercilessly by the applicant with iron rod in which she received 23 serious injuries including fracture in fimer. Therefore, the applicant is not entitled to be released on bail. 5.
Thus, considering the entire facts and circumstances of the case, submissions of learned counsel for the parties and taken into account the victim earlier lodged an FIR against the applicant and his family members for harassment over demand of dowry and after compromise, they again started harassing the victim and beaten mercilessly and she received 23 serious injuries. Therefore, in such view of the matter, this Court is not inclined to grant bail to the applicant. 6. Accordingly, the present application is rejected. October 9, 2025 A.Kr.
