O R D E R The Writ Petition is filed for the following relief: “To direct the 1st respondent to dispose the appeal submitted by the petitioner dated 04.10.2023” 2. The petitioner is the absolute owner of the property and in peaceful possession and enjoyment of the property without any hindrance till date. The subject property was inherited by the petitioner from his father, deceased Murugesan. The petitioner submits that the 2nd respondent Tahsildar, cancelled the patta, which stands in the name of the petitioner and mutated the same in favor of the 3rd respondent, without notice to the petitioner. 2/6 https://www.mhc.tn.gov.in/judis W.P.No.1663 of 2025 3. The petitioner submits that he made an appeal against the cancellation of patta before the 1st respondent, the Revenue Divisional Officer, Cuddalore, on 04.10.2023. However, there is no progress on the side of the 1st respondent. Therefore, the petitioner is before this Court. 4. Heard the learned counsels on the either side and perused the records. 5. The petitioner's case is that the 2nd respondent has cancelled the patta, standing in the name of the petitioner and mutated the same in favour of the 3rd respondent, without any notice. Challenging the same, the petitioner preferred an appeal against the 1st respondent as early as on 04.10.2023. However, the same has not been disposed of. 6. Considering the facts and circumstances of the case, a mandamus is issued to the 1st respondent to dispose of the appeal filed 3/6 https://www.mhc.tn.gov.in/judis W.P.No.1663 of 2025 by the petitioner, after issuing notice to the parties concerned, within a period of 8 weeks from the date of receipt of a copy of this order. 7. The Writ Petition is allowed.
