HIGH COURT OF JUDICATURE AT ALLAHABAD WRIT - C No. - 34371 of 2025 Court No. - 9 HON'BLE ARUN KUMAR, J.
1. Heard Sri Ankur Mehrotra, learned counsel for the petitioner and learned Standing Counsel for the respondent nos.2 and 3.
2. The present writ petition has been filed challenging the order of the Permanent Lok Adalat, Muzaffarnagar dated 25.3.2025 allowing the application for condonation of delay filed alongwith the claim petition.
3. It is contended by learned counsel for the petitioner that the claimant had moved an application for ex-gratia payment under the Mukhyamantri Kisan Evam Sarvahit Bima Yojana, which was rejected by the Additional District Magistrate (Finance and Revenue), Shamali by its order dated
20.9.2017. The claim petition was filed after a delay of six years and ten months before the Permanent Lok Adalat accompanied by an application for condonation of delay. The said application did not contain any averment, showing the reasons for inordinate delay of more than six years. As such, the Permanent Lok Adalat erred in allowing the application for condonation of delay.
4. I have perused the record. The Permanent Lok Adalat while allowing the application by its order dated 25.3.2025 recorded a finding that claimant is an illiterate person and a rustic villager, therefore, it was justified to hear the claim petition on merits.
5. In my opinion, the reasons recorded by the Permanent Lok Adalat is justified in the facts of the case and there is no reason to interfere in it. Versus Counsel for Petitioner(s) : Ankur Mehrotra Counsel for Respondent(s) : C.S.C. The Oriental Insurance Company Limited .....Petitioner(s) Khurshed And 2 Others .....Respondent(s)
6. In view of the aforesaid facts, the writ petition has been filed on misconceived ground and is dismissed. October 10, 2025 Anil WRIC No. 34371 of 2025 2 (Arun Kumar,J.) Digitally signed by :- ANIL KUMAR PATEL High Court of Judicature at Allahabad
