[2025:RJ-JP:12250] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Civil Writ Petition No. 1545/2011 Mool Chand Jaiman, son of Late Shri Ram Swaroop Sharma, aged about 70 years, resident of Mahashay Colony, Ward No.12, Kherli Ganj, Alwar. ----Petitioner Versus 1. State of Rajasthan, through the Collector, Bharatpur. 2. The Secretary, Trust Board, Rajasthan State Pensioners Medical Concession Scheme, Directorate of Pension & Pensioners Welfare, Rajasthan, Jaipur. 3. The Director, Pension & Pensioners Welfare Rajasthan, Jaipur. 4. The Treasury Officer, Bharatpur. ----Respondents For Petitioner(s) : None present For Respondent(s) : None present JUSTICE ANOOP KUMAR DHAND Order 18/03/2025 1. By way of filing this petition, a prayer has been made by the petitioner for issuing direction to the respondents to reimburse the amount of expenses incurred in the treatment taken by the wife of petitioner. 2. Contents of the petition indicates that the wife of the petitioner was suffering from knee problems, hence, her both knees were replaced at Santokba Durlabhji Memorial Hospital, wherein the petitioner has incurred expenses of Rs.4,73,329/-. After the discharge of the petitioner’s wife from the hospital, the petitioner submitted an application for reimbursement of the [2025:RJ-JP:12250] (2 of 2) [CW-1545/2011] aforesaid amount, but the same has not been done for want of renewal of medical diary. 3. This fact is not in dispute that the petitioner is a retired pensioner and holds a medical diary, if his medical diary was not renewed for a particular year and the same was renewed on 11.05.2009 while the treatment has taken place prior to that in between 09.04.2009 till 21.04.2009, this cannot be a ground for denial of reimbursement of medical bills, such objection on the part of the respondent-State is unjustified. 4. Accordingly, the petition stands allowed with direction to the respondents to reimburse the amount of medical bills to the petitioner as per the rates applicable in the approved hospitals for the treatment taken by the wife of the petitioner within a period of three months from the date of receipt of certified copy of this order. 5. Needless to observe that the respondents would comply with the order passed by this Court within a period of three months from the date of receipt of certified copy of this order. 6. Since, today both the parties have remained unrepresented before this Court and they are not aware about passing of the present order, Office is directed to send a copy of this order to petitioner as well as to the respondents, for their information, intimation and for necessary compliance. 5. All pending application(s), if any, also stands disposed of. (ANOOP KUMAR DHAND),J Aayush Sharma /207
