PUBLIC PROSECUTOR (AP) The Court made the following JUDGMENT :- (Per the Hon’ble Sri Justice K.Suresh Reddy) This Criminal Appeal is filed by the appellant/Accused, under Section 374(2) of Code of Criminal Procedure, 1973, against the judgment of conviction and sentence, dated 17.11.2020, passed in S.C.No.196 of 2017 by the learned Principal District & Sessions Judge, Prakasam at Ongole. 2. By order dated 23.03.2021 this Court granted bail to the appellant/accused. 3. Today when the matter is taken up for hearing, a letter addressed by the learned Principal District and Sessions, Prakasam at Ongole to the Registrar (Judicial), High Court of A.P. indicating that the Sub Inspector of Police, Gudlur Police Station, SPSR Nellore District, filed a memo dated 16.12.2024 stating that the sole appellant died on 19.11.2024 and attested copy of the death certificate of the appellant is also annexed to the said memo. 4. In view of the death of the sole appellant, the criminal appeal is liable to be dismissed as “abated”. 5. Accordingly, the Criminal Appeal is hereby dismissed as “abated”. Consequently, miscellaneous petitions, if any, pending shall stand closed.
