ORDER:
This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“…pleased to issue a writ, order or direction more particularly one in the nature of a Writ of Mandamus declaring the action of the respondents 2 to 4 in not registering crime basing basing on the Crime Petition ID TPTU/TPTU/030220/00226 dated 03.02.2020 and investigating the offence i.e., death of G.Munuswamy died due to the accident dated 19.10.2019 while undergoing treatment is illegal, arbitrary without following due process of law, violation of principles of natural justice and violation of Article 14 and 21 of Indian Constitution consequently direct the respondents to register the crime basing on
the Crime Petition ID TPTU/TPTU/030220/00226 dated 03.02.2020 and investigate in to the matter as per the Code of Criminal Procedure pending disposal of the above writ petition and pass….”
2. Heard Sri O.Udaya Kumar, learned counsel for the petitioner and Sri V.Farooq, learned Assistant Government Pleader for Home for the respondents.

Learned Assistant Government Pleader for Home, on written instructions, would submit that initially, a case in Crime No.300 of 2019 under Section 337 of IPC was registered basing on the complaint of the petitioner as her husband fell down when the rider of motorcycle dashed against him. After due investigation, the section is altered to Section 338 of IPC. After completion of investigation, charge sheet was filed vide CC.No.386 of 2019 no the file of V Additional Judicial Magistrate of First Class, Tirupati. While the

case was under trial, both parties compromised the matter before lok-adalat on 14.12.2019. He would further submit that thereafter, the petitioner herein has submitted a petition dated 03.02.2020 to the Superintendent of Police, Tirupati Urban District to reopen the case in Crime No.300 of 2019 as her husband died due to accident. The respondent police have conducted an enquiry and submitted a report to the Superintendent of Police, Tirupati Urban District.

Learned counsel for the petitioner would submit that let there be a direction to the Superintendent of Police to look into the enquiry report and take appropriate decision.
5. Considering the submissions, the Writ Petition is disposed of. However, the Superintendent of Police, Tirupati Urban District, is directed to look into the enquiry report and take appropriate decision over the matter. There shall be no order as to costs.
