After completion of his Schooling, he went to the United States of America in the year 1975. He acquired American Citizenship. He married an American, who passed away in November 2024. With no one around him in US, he decided to return to India in April 2025. Being a person of Indian origin, he applied for the Overseas Citizen of India status. For issuance of the said status, a birth certificate which contains the name of the applicant is necessary. Consequently, he applied to the second respondent seeking insertion of his name in the birth certificate. As it has not been complied with, he is before this Court by way of the present Writ Petition. 2/5 https://www.mhc.tn.gov.in/judis W.P.No.34717 of 2025 2. I heard Mr.Tippu Sultan, learned Government Advocate for the first respondent and Mr.Gopinathan for respondents 2 and 3. 3. The certificates enclosed along with typed set of papers points out that the petitioner was born on 04.09.1943. The Passport issued by the United States of America also points out to this effect. The downloaded Birth Certificate indicates that the Birth Certificate recorded, on the file of the Greater Chennai Corporation. The Certificate shows that a male child was born on 04.09.1943 to “Mrs.Bathirina Pinto and Mr.Pinto”. All that respondents 2 and 3 need to do is to verify whether the petitioner, 'Rudolph Louis Pinto' is the child born to the aforesaid couple on 04.09.1943. 4. Mr.Gopinath states that appropriate orders will be passed on the representation made by the petitioner on 07.08.2025. His statement is recorded.
