HIGH COURT OF JUDICATURE AT ALLAHABAD CRIMINAL MISC. WRIT PETITION No. - 22297 of 2025 Court No. - 49 HON'BLE AJAY BHANOT, J. HON'BLE MRS. GARIMA PRASHAD, J. Heard Sri Ankit Kumar Rai, learned counsel for the petitioners and learned AGA for the State respondents. The writ petition is directed against the FIR dated 03.08.2025 relating to Case Crime No. 0243 of 2025 under Sections 61(2), 314, 316(5), 318(4), 336(3), B.N.S. Police Station- Refinery, District Mathura. The first informant is Mr. Abhimaan Siwach, State Engagement Assistant Coordinator of the Pradhan Mantri Kaushal Vikas Yojna (PMKVY). In summation the prosecution case set out in the FIR is that during the course of inspection the petitioners were found to be engaged in fraudulent and illegal activities and enriched themselves by "creating profile of non-existent and ineligible students and deceiving the complainant in giving grants meant for skill development under the PMKVY." The inspection revealed certain discrepancies which included fraudulent marking of attendance, misrepresenting student enrolment, manipulating the Aadhar Enabled Biometric Attendance System to forge attendance and electronic records, illegally misappropriating funds by continuously encashing grants disbursed by the National Skill Development Corporation against fraudulent student profiles. Versus Counsel for Petitioner(s) : Ankit Kumar Rai Counsel for Respondent(s) : G.A. Ajeet Singh And Another .....Petitioner(s) State Of U.P. And 3 Others .....Respondent(s) The PMKVY is a scheme being run by the Government of India. The objective of the scheme was to equip the youth of India with various vocational skills, and empower them to become self reliant. However such fraudulent actions defeat the most laudable purpose of the scheme. These observations are without prejudice to the rights of the petitioner. However they have been made only to under score the importance of expeditious investigations in the matter as per law. At this stage the learned counsel for the petitioners submits that despite lodgment of the FIR funds are being disbursed to the petitioners, hence no fraudulent activities were committed. In fact this fact requires further investigation into the matter by the higher authorities of the National Skill Development Corporation as to how the funds have been disbursed when the institution has been found to be engaged in fraudulent activities. Prima facie offence is clearly disclosed against the petitioners. The writ petition is liable to be dismissed and is dismissed.
