CRM-M-52757-2025
Date of Decision : 23.09.2025
SAHIL @ NANNA
…. PETITIONER V/S STATE OF PUNJAB
…. RESPONDENT
CORAM:HON'BLE MR. JUSTICE SUBHAS MEHLA Present : Ms. Vandana Sharma, Advocate and Ms. Prabhjot Kaur, Advocate
for the petitioner.
**** SUBHAS MEHLA, J. (Oral)
1.
The petitioner is seeking regular bail in FIR No.280 dated 19.12.2018, under Sections 379-B, 34 IPC registered at Police Station Division No.4, District Ludhiana.
2.
Learned counsel for the petitioner contended that the petitioner is granted bail on merits in the present case but as he was undergoing treatment at a Rehabilitation Center, failed to appear before the trial Court. Consequently, his bail was cancelled and non-bailable warrants were issued against him. Thereafter, he was declared proclaimed offender but later on he was arrested. He is in custody for the last 09 months. It is further submitted that the trial will take time to conclude as only one prosecution witness has been examined, one has been given up and eight witnesses are still to be examined. 3. Notice of motion. 4. Mr. Nitesh Sharma, DAG, Punjab, accepted notice on behalf of respondent-State and submitted that the present petitioner is misusing the concession of bail. It is contended that after granting bail, the petitioner Anju Goel 2025.09.26 14:45 I attest to the accuracy and integrity of this document Chandigarh

failed to appear before the trial Court and his presence had to be secured through warrant of arrest. Learned State counsel further submitted that if the petitioner is again released on bail, he will certainly flee away from the process of law. 5. Custody certificate of the petitioner filed by learned State counsel is taken on record. 6. Heard. 7. Keeping in view the contentions of learned counsel for the petitioner that the petitioner was earlier granted regular bail on merits in this case but he failed to appear before the trial Court as he was admitted in a Rehabilitation Centre and thereafter, he was arrested in this case and is presently in custody for the last 09 months; trial will take time to conclude as a number of prosecution witnesses are yet to be examined; no useful purpose would be served by keeping him in custody for any further period; this Court deems it a fit case to grant the concession of regular bail to the petitioner. 8. Therefore, without expressing any opinion on the merits of the case, the instant petition is allowed with a condition that the trial Court will impose conditions as deemed appropriate to secure the presence of the petitioner. The petitioner is ordered to be released on regular bail on his furnishing requisite bonds to the satisfaction of the trial Court/Duty Magistrate/Chief Judicial Magistrate concerned.
