(ORAL) FIR No. Dated Police Sta1on Sec1ons 147 21.07.2024 Kotwali Paala, District Paala 406, 420, 506 IPC The present peon has been filed under Secon 528 of BNSS, 2023 seeking transfer of invesgaon of above caponed FIR from Paala Police to an independent invesgang agency or to another district police, on account of bias, collusion and unfair invesgaon. 2. State counsel on instrucons submits that cancellaon report in this case has already been filed. 3. A7er arguing for some me, counsel for the peoner wants to withdraw the present peon with liberty to file a protest peon before the concerned Magistrate. Counsel for the peoner submits that he has apprehension that the Magistrate would direct further invesgaon by the same invesgator. 4. Given above, present peon stands disposed of having been withdrawn with liberty as prayed for. It is clarified that if the stage arises, it shall be permissible for the peoner to raise the grievance that the invesgaon ought to be conducted by a different invesgator. All pending miscellaneous applicaons, if any, stand disposed of.
